1.1 “Quantum Magnetics”, “we”, “our”, or “us”,means - Micro-One Pty. Ltd. as trustee for The Paradise Trust, Trading as Quantum Magnetics, of Unit 25, No. 70 Roberts Street Osborne Park W.A. 6017.
1.2 “Customer”, “client”, “you” or “your”,means -the company, partnership, sole trader, individual or any other entity who enters into this agreement by purchasing goods or services from Quantum Magnetics.
1.3 “Products“, “Goods”, “Services”, “Magnets”, means – any item that has been purchased from the Quantum Magnetics website.
2 THIS AGREEMENT
2.1 The customer acknowledges and agrees that these Terms and Conditions of Sale shall be the only Terms and Conditions of Sale that apply to the agreement between Quantum Magnetics and the customer.
2.2 The customer agrees that these Terms and Conditions of Sale shall embody the whole agreement between the parties and shall apply to the exclusion of all other terms and conditions, including any terms and conditions of the customer (whether they are on the customer’s order,the customer’s forms or otherwise).
2.3 The customer agrees to be bound by these Terms and Conditions of Sale.
3.1 All prices are quoted in Australian Dollars.
3.2 All prices quoted on the Quantum Magnetics web site, by email, by telephone, in person or by any other means are believed to be true and correct at the time of quotation.
3.3 The prices of each and every product shown on the Quantum Magnetics website are for the product only. They do not include any taxes, delivery charges, credit card surcharges etc. These ancillary charges will be added at the checkout prior to the customer being asked to disclose their credit card numbers etc.
4.1 All payments for goods purchased from Quantum Magnetics are to be made in Australian Dollars.
4.2 Payments shall be made in full at the time of placing the order.
4.3 Credit terms are not available from Quantum Magnetics unless prior arrangements have been made in writing as follows :
a) The customer has completed in full, a Quantum Magnetics credit application form.
b) Quantum Magnetics have verified and approved the customers application.
c) Quantum Magnetics have notified the customer in writing that they have been granted a credit facility.
4.4 Quantum Magnetics reserve the right to withdraw or suspend any credit facility without notice.
4.5 Quantum Magnetics reserve the right to delay, or withhold the supply of goods to the customer,until all of the customers outstanding payments to Quantum Magnetics have been made in full.
4.6 The customer agrees to pay any and all costs and expenses (including legal expenses) incurred by Quantum Magnetics in obtaining or attempting to obtain payment of any overdue account of the customer.
4.7 Quantum Magnetics reserve the right at our sole discretion to determine what method of payment will be accepted from any customer, i.e. in certain circumstances (depending on the location of the customer, the value of the sale, or any other factors we deem to be relevant) we may decide that the only acceptable terms of payment are direct deposit or cash etc.
5.1 G. S. T. does not currently apply to the sale of goods exported from Australia, however should such taxes be levied at some time in the future they will be passed on to the customer.
5.2 All prices shown on the Quantum Magnetics website prior to the checkout are quoted exclusive of Goods and Services Tax (G.S.T.) and any other taxes.
5.3 All sales made to customers located within Australia are subject to G. S. T. which will be added at the checkout.
5.4 All Federal, State and Territory taxes, charges and fees will be passed onto the customer and must be paid by the customer.
6.1 The customer will be responsible for the payment of all freight / delivery costs relating to any goods that they order through this web site.
6.2 All sales will have the freight / delivery charges disclosed at the checkout and added to the cost of the goods ordered prior to the customer entering any payment details.
6.3 The freight / delivery charges are calculated using a formula relating to the weight of the goods that have been ordered and the distance that they will be travelling to reach you. Due to international air freight restrictions relating to magnets, we often need to provide extensive magnetic shielding to render the package suitable for air transportation. Depending on the size and quantity of the magnets to be shipped, the amount of shielding that is required can sometimes be difficult to calculate. The shielding may affect the final weight of the consignment and also the freight / delivery charges. If this situation does occur, or for some other reason we need to charge you more for your freight / delivery than was previously quoted to you by our automatic freight calculator, we will advise you of any increase by email prior to dispatching the goods to you. At that time we will give you the opportunity to cancel your order at no cost to you.
7.1 Orders placed on this web site may not be cancelled by the customer without written approval from Quantum Magnetics. Such approval is at our sole discretion and approval will not be given if the goods have already been dispatched, or if they have been specially ordered for the customer from our manufacturing facility.
7.2 In the event that Quantum Magnetics do accept a cancellation, we reserve the right to charge the customer (at our discretion) any reasonable fee for work carried out in relation to the cancelled order, including but not limited to a restocking charge and also a processing fee.
8.1 Quantum Magnetics supply only the very best quality magnets and magnetic products available anywhere in the world. The condition, strength, quality and quantity of our products are carefully inspected, checked and tested several times prior to them being dispatched to you. As such you can be assured that any product that you order from us will almost certainly arrive in good condition. Having said this, we only have limited control over the period of transportation from our warehouse until the order reaches you. With this in mind, if you receive any product from us that is damaged or faulty, you must contact us immediately to advise us of the damage. Claims for Transport damaged or short supplied goods must be made to Quantum Magnetics in writing within 2 working days of receipt of the goods.
9.1 Customers are encouraged to make their selection of magnets very carefully as Quantum Magnetics will only exchange magnets that are faulty or are not as they were described on our website.
9.2 Any goods returned to Quantum Magnetics must be in the original packaging and in an unmarked and undamaged condition.
9.3 No refund will be made for any freight / delivery costs to, or from our premises.
10 DELIVERY TIMES
10.1 Quantum Magnetics will make every effort to comply with a customers request for the delivery of an order by a requested date, however under no circumstances will we be liable for any losses or damages of any kind whatsoever resulting from, or in relation to our inability to meet a customers delivery deadline.
10.2 The customer acknowledges and agrees that they will not make any claim against Quantum Magnetics for any loss or damage incurred as a result of a late delivery.
11 REFUSAL TO SUPPLY
11.1 Quantum Magnetics reserve the right at our sole discretion to reject or delay any order.
11.2 Quantum Magnetics reserve the right at our sole discretion to refuse to supply goods to any person, company, partnership or sole trader without entering into the reasons for the refusal.
12.1 The customer hereby agrees to indemnify Quantum Magnetics against all claims relating to the loss of goods,or the damage to goods or items howsoever caused.
13 TITLE OF GOODS
13.1 The title of goods purchased from Quantum Magnetics does not pass to the customer until the goods have been paid for in full, including any and all charges, fees or taxes relating to those goods or the sale.
14.1 Quantum Magnetics supply only the very best quality magnets and magnetic products available anywhere in the world. The condition, strength, quality and quantity of our products are carefully inspected, checked and tested several times prior to them being dispatched to you. We do everything that we possibly can to ensure that any product that you order from us will meet your expectations in every way.
14.2 All goods supplied by Quantum Magnetics are covered by a one year (12 Month) limited warranty. The Quantum Magnetics warranty covers faulty materials and workmanship and cannot be excluded under the Australian Consumer Law. You maybe entitled to a replacement or a refund for a major failure of a product. You may also be entitled to have the goods repaired or replaced (At the sole discretion of Quantum Magnetics) if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
14.3 The Quantum Magnetics warranty does not cover items that have been treated improperly, misused, or show signs of abuse.
14.4 The Quantum Magnetics warranty does not cover freight or transportation costs for the goods to be returned to our premises or for the re – delivery of any goods to the customer.
15 CLAIMS PROCEDURE
15.1 In the unlikely event that you are not happy with the condition or the performance of our products, you may wish to make a claim under the Quantum Magnetics Warranty.
15.2 Claims made under the Quantum Magnetics warranty will only be considered after following claims procedure has taken place -
a) You must advise us in writing of your complaint within 24 hours of you becoming aware of a problem with any goods that have been supplied to you by Quantum Magnetics.
b) You must describe the nature of the problem or complaint in detail. The provision of photos and any other evidence that you may have of your complaint can be helpful in establishing the nature of the problem.
c) You should state the reason, or reasons why you feel that you may be entitled to make a warranty claim.
d) You must provide us with a copy of a Tax Invoice that clearly shows the details of the goods that you purchased from Quantum Magnetics and the date of the purchase.
Only after you have provided this information to us we can then decide what further action may be required.
